Introduction

Please read through the Terms and Conditions thoroughly before booking. Booking a class with Francesca Lily Yoga means you fully agree and accept the T&C’s. 

 

In these T&C’s, the following definitions apply; 

  • ‘Service’ means any activity offered by or on behalf of FLY (including but not limited to online (live-streamed/pre-recorderd/on-demand) and in-studio classes, workshops, courses, retreats, events, private / 121 tuition

  • ‘FLY’, ‘Francesca Lily Yoga’, ‘we’/‘us'/ ‘our’ / means Francesca Lily Yoga. And ‘Student’/‘you’/your’/‘yours’ means you, the direct client

  • ‘Registration Form’ means the registration form accepted by a Student electronically in the FLY Web App

  • ‘Studio’ means any rented FLY premises

  • ‘Website’ means www.francescalilyyoga.com. ‘Online’ refers to any services that are live-streamed virtually or are recorded and shared digitally on-demand via You-Tube, Zoom or any other electronic means

 

 

These T&C’s are incorporated into creating an account within the FLY web app and any Service is subject to these Terms. FLY reserves the right to vary and revoke these T&C’s occasionally and only where necessary or desirable for all. Any such changes will be published on the FLY website and communicated as effectively as possible. 

 

Fitness and Health

  • By accepting these terms, all clients agree that you are participating in any service in person and/or online at their own risk. 

  • FLY requires all clients to update their account profile within the FLY web application stating in the Health issues section any condition but not limited to; previous or current injuries, health conditions and pregnancy that may affect your practice - this information will be kept confidential.

  • Should your health situations change, it is your responsibility to keep your profile updated.

  • You agree that yoga is not used as a substitute for medical attention, diagnosis or treatment but as a great practice with plentiful benefits.

  • Should you have any health issues, It is your responsibility to gain professional sign off from a medical professional before you take part in the services.

  • FLY reserves the right to refuse access to you or any customer if we in any way doubt your health and their ability to safely take part in the classes.  

  • By attending classes/courses/workshops you accept the risk of injury from performing any exercises. Francesca Lily Yoga accepts no liability for injury to the customer. By booking, all customers adhere to these full terms and conditions, which waive FLY responsibility for physical injury cause by any service.

  • All customers will be asked to agree to the Waiver via the FLY web app when creating their account, which outlines these terms and conditions.

 

Pregnancy

  • Unless in the description, FLY classes are not pregnancy specific so you must therefore not attend a non-pregnancy specific class if you are pregnant. 

  • Pregnancy specific classes will be labelled in the description and are suitable for mums to be from 13+ weeks.

  • By accepting these terms, you agree to the following;

  • I acknowledge that I have consulted with my midwife and or doctor prior to practicing in any service.

  • I fully understand that I am participating completely voluntarily and accept responsibility for any potential risks and ramifications of my actions in connection to my participation.

- I accept all responsibility for my health and any resultant injury or mishap that may affect my and/or my baby’s well-being or health in any way.  

- I understand that I must practice at my own pace, and only engage in poses that feel intuitively right.  

- I hereby release FLY and its teachers, from any liability now or in the future. I affirm that I have read and fully understand the above and have read and accept the full Terms & Conditions/Registration Form.      

 

COVID-19/Communicable Disease and/or Viruses

  • FLY takes the all communicable disease/viruses not limited to the COVID-19 coronavirus pandemic breakout in 2020 very seriously and has put in place measures to help reduce spread. However, FLY cannot guarantee that you, your family, or your guests will not become infected with any communicable disease/viruses.  

  • You acknowledge the contagious nature of COVID-19 and other possible communicable diseases/viruses and voluntarily take the risk that it is possible that attending classes, events and activities at FLY may place you in close physical contact with other attendees and teachers which could increase the risk that you or your family members/acquaintances, contract COVID-19 and other communicable disease/viruses and you are aware this could result in personal injury/illness/disability and death. 

  • By practicing with FLY, you voluntarily agree:

(1)    to assume all of the risks and accept sole responsibility for any injury, illness, damage, loss, claim, liability, or expense, of any kind (including, but not limited to, personal injury, disability, and death) that may occur to you or your family members in connection with attendance at FLY or as a result of participation in FLY services  

 

(2)    covenant not to sue FLY including teachers/clients/helpers including all liabilities, claims, actions, damages, costs or expenses of any kind, based on the actions, omissions, or negligence of FLY, including teachers/clients/helpers whether a COVID-19 or other communicable disease/virus infection occurs before, during, or after attending FLY rented facilities or participating in any FLY service. 

 

 

Booking a class

  • FLY classes are open to everyone (at your own risk). We ask that you only attend a class if you feel well. If you are unwell, are showing any symptoms of any current communicable disease,  or have recently returned from a country that requires appropriate quarantine, please do not visit FLY. 

  • All classes must be pre-booked online via your profile in the FLY Web App. 

  • All class cancellations must be made within a respectful 12 hours prior to the class starting & a refund notification will be sent to FLY to transact.

  • When booking, make sure you select the correct version of the class either STUDIO or ONLINE.      

Attending a class

  • FLY requires you to maintain social distancing at all times.

  • Please do not arrive any earlier than 10 minutes before the class starts to reduce the time you may have to wait outside the FLY rented premises in close proximity to others. If you’re waiting outside the studio, please maintain social distancing.

  • Place your mat down in one of the designated spaces to ensure a safe distance between mats.

  • Please keep/store your belongings next to your mat during the whole class.

  • Please arrive no earlier than 10 minutes before the class start time to accommodate suitable spacing between mats. 

  • Please do not enter the studio until you are invited in by the teacher to ensure the space has been appropriately prepared.

  • Please sanitise your hands on entry to the studio (sanitiser will be provided).

  • Please wear a mask at all times when you are not on your yoga mat.

  • Please arrive dressed  and ready for practice.

  • Please bring your own yoga mat and any props you may need. No mats or props will be available for use.

  • Before you leave, please clean and sanitise the space around your mat, and your own mat and props.

  • Please do not wander around the studio space once you have laid out your mat.

  • Rented studio space is not FLY’s responsibility to prepare/clean and students should be aware that they are using the space entirely at their own risk.

  • Should you become unwell after visiting FLY, it is a requirement that you get in touch (francescalilyyoga@gmail.com) with information about your symptoms and the day you attended the studio for Track and Trace purposes.

 

Online services Health and Safety

  • For clients participating in any FLY online services, you do so at your own risk, including but not limited to live-stream Zoom classes and any recordings (i.e. YouTube)

  • You take full responsibility for your health and safety, including any injuries. It is your responsibility to inform the teacher via the Health issues section of your profile in the FLY Web app.

  • FLY services are for adults only unless the service is clearly stipulated for young people or families (for these services, it is the parent/guardian's responsibility to ensure the safe participation of people under 18. 

  • FLY recommends you: Use a suitable, non-slip floor space, having removed any potential obstructions in the vicinity.

  • To avoid activities if you have, or suspect you may have, any current health concerns, injuries, aches and pains; which affect your mobility or are likely to cause you concern when practicing; including but not limited to; high blood pressure; low blood pressure/fainting; arthritis; diabetes; epilepsy; heart problems; asthma; depression; detached retina/other eye problems; recent fractures/sprains; recent operations; back problems; knee problems; neck problems; recent       pregnancies; if you are you pregnant; or anything else that may affect your ability to participate safely.     

  • Inform the teacher via the notes section in your profile if you are a beginner or need any      support before you start the session. 

 

 

Data Protection and GDPR

  • FLY processes personal data lawfully, fairly and in a transparent manner.

  • Any personal information such as name/contact will only be used to improve and offer communication between FLY and student about but not limited to, services/facilities/pricing/cancellations/changes/payments/market research. Information will not be passed on any third parties.

  • FLY may keep your information for a reasonable period for these purposes. 

  • If your personal details change, if you change your mind about how you wish to be contacted, or if you have any queries about how your information is used, please contact FLY at francescalilyyoga@gmail.com. You hereby consent to the use of your information, including sensitive personal data relating to your health and fitness, for the reasons and in the manner set out above.  

  • FLY collects personal data only for specified, explicit and legitimate purposes.

  • A student can request for their account in the FLY web app to be suspended if it is no longer required

  • Individuals have the right to make a subject access request so please contact FLY if you have any questions regarding your data. Proof of identification may be required.

  • If FLY discovers that there has been a breach of personal data that poses a risk to the rights of individuals, it will report it to the Information Commissioner within 72 hours of discovery and will record all data breaches regardless of their effect

 

Other

  • FLY cannot be held responsible for any loss or damage to personal belongings at class or retreats.

  • Photos and videos may be taken during class/retreats that may be used for promotional purposes. (If you would rather not feature please contact FLY).

  • Prices shown on page are all in GBP.

  • FLY reserves the right to move location, time, teacher or weekly availability of class but always promises to keep students updated through social media - instagram (@francesca.lily.yoga), the FLY Facebook page or text message.

  • Up front purchases of Class passes are not refundable. 

  • FLY reserves the right to review and change the price of services at our sole and absolute discretion. 

  • FLY reserves the right to refuse entry to anyone arriving after the start of the class in order to prevent injury and to be mindful of the teacher and other participants in the class.

  • Each participant must have their own account within the FLY Web App.
